Musk vs. Altman: The AI Showdown in Court
Technology magnates Elon Musk and Sam Altman are set to engage in a significant legal confrontation concerning accusations of betrayal, deceit, and unchecked ambition that have obscured the previously aligned vision of the two billionaires for advancing artificial intelligence. The trial, set to commence Monday with jury selection, focuses on the 2015 inception of OpenAI, the creator of ChatGPT, which began as a nonprofit startup largely financed by Musk before transforming into a capitalistic enterprise currently valued at $852 billion. The trial’s outcome has the potential to influence the dynamics of power in AI, a transformative technology that is increasingly viewed with apprehension as a possible disruptor of employment and a fundamental threat to the survival of humanity. The perceived risks are among the factors that Musk, the world’s wealthiest individual, references for initiating a lawsuit in August 2024, which will now be adjudicated by a jury and US District Judge Yvonne Gonzalez Rogers in Oakland, California. The civil lawsuit alleges that Altman, the CEO of OpenAI, along with his principal associate, Greg Brockman, has betrayed Musk by deviating from the original mission of the San Francisco-based company, which was to serve as a benevolent steward of groundbreaking technology. The lawsuit contends that they transitioned into a profit-driven strategy without his knowledge.
OpenAI has dismissed Musk’s allegations as an unfounded instance of sour grapes intended to undermine its swift expansion and enhance Musk’s own xAI, which he introduced in 2023 as a rival. Musk, having invested approximately $38 million in OpenAI between December 2015 and May 2017, originally aimed to secure damages exceeding $100 billion. However, any damages at this stage are expected to be significantly reduced following a sequence of pre-trial rulings that were unfavorable to Musk. Musk has subsequently withdrawn his request for personal damages and is now pursuing an undisclosed sum intended to support the philanthropic initiatives of OpenAI’s charitable division. The funding will predominantly come from OpenAI’s for-profit ventures and Microsoft, which emerged as the principal investor following Musk’s withdrawal of financial support. Musk’s lawsuit additionally aims for Altman’s removal from OpenAI’s board. Musk’s decision to cease funding the company led to a contentious rift between the former allies. Musk indicated that his actions were a reaction to the misleading behavior that OpenAI’s board identified, which led to Altman’s dismissal as CEO in 2023, prior to his reinstatement just days later.
However, the trial also presents potential pitfalls for Musk, who was recently found liable by a different jury for misleading investors during his $44 billion acquisition of Twitter in 2022. Any damaging details regarding Musk and his business tactics could prove particularly detrimental at this juncture, as his aerospace company, SpaceX, is poised to enter the public market this summer through an initial public offering that has the potential to establish him as the world’s first trillionaire. However, it appears that the trial is poised to deliver compelling drama, featuring divergent testimonies from two of the most significant and divisive personalities in technology: the 54-year-old Musk and the 41-year-old Altman. “Part of this is about whether a jury believes the people who will testify and whether they are credible,” Gonzalez Rogers stated during a court hearing earlier this year, elucidating her rationale for why she believes the case warranted a trial. The judge is set to render the ultimate verdict in the case, while the jury will fulfill an advisory capacity. Musk, with an estimated fortune of approximately $780 billion, has consistently been recognized as a visionary due to his involvement in founding digital payment innovator PayPal, electric vehicle manufacturer Tesla, and aerospace company SpaceX. However, he has also incited reactions due to his social media remarks, unmet commitments regarding Tesla’s autonomous driving technology, and his role in cost reduction during President Donald Trump’s administration last year.
Some of Musk’s erratic behavior has been linked to allegations of hallucinogenic drug use; however, Gonzalez Rogers determined that inquiries regarding his suspected ketamine use are not permissible during the trial. However, the judge has permitted questioning of Musk regarding his participation in the 2017 Burning Man festival in Nevada, an event characterized by its liberal atmosphere and notable drug consumption. The judge has permitted questioning of Musk regarding his association with Shivon Zilis, a former board member of OpenAI and the mother of multiple children he has fathered. Altman, with a fortune estimated at approximately $3 billion, became a prominent figure in the public eye following the late 2022 launch of ChatGPT. The surge in technology catalyzed by that conversational chatbot has prompted comparisons of Altman to a contemporary iteration of the nuclear bomb creator, J. Robert Oppenheimer. Initially celebrated as a pioneer, Altman is now encountering backlash due to concerns regarding the potential risks associated with AI. Earlier this month, the New Yorker magazine released a profile that characterized him as a morally questionable executive. Days later, a 20-year-old man, concerned about the implications of AI on society, was apprehended on attempted murder charges for launching a Molotov cocktail at Altman’s residence in San Francisco.
The contrasting accounts of Altman and Musk are anticipated to provide insights into the thought processes that catalyzed the AI race, alongside the deterioration of their relationship. The alliance was established in 2015 with a commitment to develop artificial intelligence in a manner that prioritizes responsibility and safety, contrasting with the profit-oriented approaches of companies led by Google co-founders Larry Page and Sergey Brin, as well as Facebook founder Mark Zuckerberg, as indicated by evidence presented prior to the trial. The specifics of the contentious split between the two individuals were documented in a February 2023 email correspondence that emerged as part of the evidence in the lead-up to the trial. After expressing admiration to Musk, Altman conveys his gratitude: “I am tremendously thankful for everything you’ve done to help – I don’t think OpenAI would have happened without you – and it really (expletive) hurts when you publicly attack OpenAI.” Musk stated, “I hear you, and it is certainly not my intention to be hurtful, for which I apologise, but the fate of civilisation is at stake.”
